Changes in the conditions of foreigners employment!

Regulation of the Minister of Economic Development, Labour and Technology from the 20th November 2020 amends the Regulation on cases in which the entrustment of work to a foreigner on the territory of the Republic of Poland is allowed without the need to obtain a work permit. From the 1st of December 2020 it will become possible to employ a person without the need neither of registering statements of work entrustment nor obtaining work permits in such cases as:

  1. Holding a valid visa issued for the purpose of arrival to Poland on humanitarian grounds, for reasons of national interest or international obligations.
  2. Holding a valid visa with the notation “Poland. Business Harbour”.
  3. Being a doctor or a dentist who has the right to pursue the profession under the rules laid down in the Act of 5 December 1996 on the doctors and dentists professions.
  4. Holding a right to practise as a nurse or midwife that has been granted or recognised in accordance with the provisions of the Act of 15 July 2011 on the nurse and midwife professions.
  5. Being qualified to practice the profession of paramedic in accordance with the provisions of the Act of 8 September 2006 on the National Medical Emergency Service.
  6. Working in the private domestic service of a member of the diplomatic mission or consular office of a foreign country or of another person assimilated to a member of the diplomatic mission or consular office by virtue of laws, agreements or generally accepted international custom.

The above mentioned regulation allows participants of the Poland. Business Harbour Programme to work in Poland without the work permits or registered work entrustment statements. This means that during the period of validity of the visas with Poland. Business Harbour notation, their holders will be treated equally as Polish citizens and the employer doesn’t need to do anything to employ them legally.
